Typical Attorney's Fees and Costs


Apartment Communities

 

Our typical attorney's fee for conducting an uncontested residential eviction for possession only from non-payment of rent involving non-government subsidized housing starts out at $300.00, exclusive of filing fees and costs.

Filing fees and processing costs are additional and vary from county to county. Costs typically include, but are not limited to, filing fees for the eviction (typically $185.00), a summons processing fee ($10.00 per summons per defendant being served, minimum of $20.00), service of process costs by either the county sheriff or private process server (market rate) and, if necessary, the cost for the Sheriff's deputy to execute the Writ of Possession and remove the tenant from the premises (typically $90.00 for the first tenant, and $40.00 for each additional tenant). 

Most evictions for unpaid rent go uncontested. However, if the tenant files any responsive pleading, answer, or counterclaim to the complaint for eviction, the case becomes contested, and the attorneys' fees and costs will increase.  If a court appearance is required, an additional fee of $250.00 for the court appearance is charged.
